Aviation - 49 CFR Part 175

The requirements listed under §175 Subparts A-C apply to the offering, acceptance, and transportation of hazardous materials in commerce aircraft and entails both passenger and cargo aircraft.

Passenger aircraft is defined as an aircraft that carries any person other than a crew member, company employee, an authorized representative of the United States, or a persona accompanying a shipment. Cargo aircraft is an aircraft used to transport cargo and is not engaged in carrying passengers.

HAZMAT employees and employers that must adhere to these regulations include the following:

  • Air carriers
  • Indirect air carriers
  • Freight forwarders and their flight and non-flight employees
  • Agents
  • Subsidiary and contract flight personnel that include cargo, passenger and baggage acceptance, handling, and loading and unloading personnel
  • Passengers that carry any hazardous material on their person or in carry-on or checked baggage

Hazardous material that is not prepared in accordance with §175 must not be offered or accepted for transportation aboard an aircraft.
