Waterways - Applicability
This course provides an overview of the safety concepts and procedures for transporting hazardous materials by vessel. The people involved in the chain of transportation are classified as either a HAZMAT employer or a HAZMAT employee.
A HAZMAT employer is any person who uses one or more employees in connection with the following:
- Transporting HAZMAT in commerce
- Causing HAZMAT to be transported or shipped
- Representing, marking, certifying, selling, offering, reconditioning, testing, repairing, or modifying packagings
A HAZMAT employee is any person who is employed by a HAZMAT employer and who directly affects HAZMAT transportation safety, including a person who:
- Loads, unloads, or handles HAZMAT
- Tests, reconditions, repairs, modifies, marks, or otherwise represents packagings as qualified for use in the transport of HAZMAT
- Prepares HAZMAT for transportation
- Is responsible for the safety of transporting HAZMAT
- Operates vessels used to transport HAZMAT
A shipper refers to a person, organization, or enterprise that performs or is responsible for performing any pre-transportation functions.
An operator refers to a person, organization, or enterprise engaged in or offering to engage in vessel operation.
